By acknowledging these terms and conditions, you hereby consent to the use of your personal data in accordance with the principles set forth here. The consents are highlighted in the text. Your consent shall be recorded by us in a protocol and sent to you via e-mail.

or via e-mail to the e-mail address: info (at) footfiles (dot) com

This general data protection declaration shall apply to all personal data collected under the domain http://www.footfiles.com/.

1. Online competitions and contests

If you participate in interactive events with us such as online contests or competitions, we shall have to request your name, your e-mail address, your age, and your postal address. By doing so you can participate in the contests and we can prevent minors from participating. Moreover, we shall be able to notify you if you win and have the winnings sent to you. For each contest or competition in which you would like to participate, you shall have the option of logging in without registration each time or the quick, simple process of registering a user account (see III.).

In the case of special contests through sponsoring partners of 4SD, it is possible that we shall have to forward your data to the sponsoring partners. Should that be the case, for each contest we shall separately inform you as to whom the data are being forwarded, and you shall be free to decide whether or not you wish to consent to the forwarding and to participate in the contest.

2. Online orders

If you place an online order through our website in one of our own shops, we shall have to ask for your name, your e-mail address, and your address, as well as your shipping address, your bank routing number and your bank account or your credit card number, their expiration date, and their security code. Only in this manner shall we then be able to process and carry out your order and inform you as to the order status. These data are used exclusively for processing and fulfilling the contractual agreement entered into with you as well as for advertising purposes, if and to the extent that such is lawfully permitted or consented to therein.

3. Functioning and use of cookies

3.1 A cookie is a text data file which is copied from a web server onto your hard drive. Cookies cannot execute any programs or transfer any viruses onto your computer. Cookies are distributed uniquely to you and can be read only by a webserver in the domain from which the cookie was issued to the user. A primary purpose of cookies is to provide a time-saving feature. The additional purpose of cookies is to inform a webserver that you are returning to a particular site. You can refuse or accept cookies. The majority of web browsers accept cookies automatically, but normally you can change your browser settings and prefer to refuse cookies. If you refuse cookies, then it is possible that you will be unable to use all of the interactive features of a website you visit.

3.2 We use two different types of cookies. One cookie is used to enable one of the so-called smart log-ins. That cookie contains as information only the community profile name of the respective user. In this manner, the community profile name already appears at the beginning of the registration in the field intended for this purpose. The cookie is also deleted whenever the community profile is deleted (see above).

Further, the operator uses session cookies, i.e., such cookies that remain in existence only for the duration of the visit to the website. These cookies contain data entered by the user during the individual reporting and are deleted again when the connection to the domain of the operator is deleted. The session cookies are supposed to prevent information from having to be repeatedly entered within the same session.

4. What are your rights?

We are concerned about informing you as to your rights within the meaning of the provisions of data protection law.

4.1 Right to information

4.1.1 What is the right to information? You have a right to information: in other words, you can inquire at any time as to the purpose for which we are saving your data and you can directly inquire as to the data about your person that are saved.

4.1.2 How can you make use of the right to information? Quite simple: send us an e-mail containing the data about which you wish to obtain information, verification of your identity (e.g., a digital signature, etc.) and a brief explanation to info (at) footfiles (dot) com. We shall require identification such as a digital signature or another suitable verification of identity in order to protect your data from any possible misuse by third parties having no rights to it who are pretending to be you. After the identification verification we shall answer you in writing or via e-mail.

4.1.3. What does the exercise of the right to information cost? The information is at no charge—only in the event of demonstrably considerable expense shall we charge you a fee to exercise the right to information, which fee can be based upon the demonstrable expense. In this event we shall inform you ahead of time about any expenses that will be incurred and request your consent.

4.2 Right to correction, deletion, and blocking

4.2.1 What is the right to correction and deletion? If you know that your information has changed, or if you have any doubts as to the accuracy of the information about you that is stored, then you can demand the information be corrected or deleted.

4.2.2 How can you make use of this right? We provide you online the opportunity at any time to make the correction/deletion of the current data yourself via registered nickname and password. In the event that historical data inventories are involved or that you are not a registered member, then it is also quite simple: send us an e-mail in which you precisely specify the data that you wish to have corrected/deleted (e.g., using a digital signature), as well as a brief explanation to info (at) footfiles (dot) com.

We have to insist on identification using a digital signature or another suitable means of identification, in order to protect your data from unlawful inquiries about “correction/deletion.” Unfortunately, we cannot perform any deletion of data that are necessary to fulfill the contractual agreement entered into with you. After reviewing the appropriateness and correctness of the inquiry, we shall carry out the correction/deletion and shall then inform you in writing via e-mail.

4.2.3 What does the use of this right cost? The correction/deletion is at no charge—only in the event of a demonstrably considerable expense will we charge you a fee for the use of the correction/deletion, and this fee can be on the basis of the demonstrable expense. However, in this case we will first inform you as to any expenses incurred and ask for your consent.

6. Use of Facebook social plug-ins

Our internet presence uses social media plug-ins (“Social Media Plug-ins” or “Plug-ins”) of the social network facebook.com; these Plugins are operated by Facebook, Inc. (“Facebook”), 1601 S. California Ave., Palo Alto, CA 94304, United States of America. The Plug-ins are identified with a Facebook logo or the addendum “Facebook Social Plug-in.”

If you retrieve from our internet presence a website that contains such a Plug-in, your browser establishes a direct connection with the Facebook servers. The content of the Plug-in is transferred from Facebook directly to your browser and integrated by it into the Website.

By integrating Plug-ins, Facebook receives the information that you have retrieved the corresponding site of our internet presence. If you are logged onto Facebook, then Facebook can assign your visit to your Facebook account. Whenever you interact with the Plug-ins, e.g., by clicking on the “Like” button or leaving comments, the corresponding information will be directly transmitted from your browser to Facebook and saved there.

The purpose and scope of the data collection and the additional processing and use of the data by Facebook as well as the rights and settings options you have in this regard to protect your privacy can be found in Facebook’s privacy notice.

Accordingly, the content of the “AddThis” Social Media Plug-in is transmitted to your browser directly and integrated into the website. AddThis LLC simultaneously receives information about the website retrieved by you and leaves a cookie on the device you use, in order to enable it to recognize the site again during a subsequent visit. The information transmitted by your browser (including your IP address) is transmitted to AddThis LLC and compiled there in an anonymized user profile. These user profiles serve as the basis to be able to configure online services offered that are retrieved by you in a personalized manner related to your interests. Additional information concerning the purpose and scope of the data collection by AddThis LLC can be found in the AddThis privacy policy at:

http://addthis.com/privacy/privacy-policy
